Reservation Terms and Conditions
Reservations
Delos Holidays will proceed with the reservation of the services, based on the Customer’s on-line booking request details. Delos Holidays will confirm the reservation sending a proforma invoice to the Customer. The proforma invoice will contain the deposit payment date and the balance payment deadline. The Customer will reconfirm the tour package reservation by sending a deposit payment within the confirmation deadline.
Services and extras
During the tour Delos Holidays will provide the tour package services confirmed to the Customer. Any extra services will be paid by the Customer on the spot. Delos Holidays will not be liable for extra services not paid for by the Customer.
Documentation
The tour package services will be covered by the Delos Holidays vouchers. The vouchers will be sent to the Customer before the departure upon the balance payment.
Payments
A 30% deposit payment of the total amount will be requested to reconfirm the tour package reservation done by the Customer; The balance payment must be done 60 days prior the arrival date;
Cancellation terms
The tour package can be cancelled without penalty up to 60 days prior arrival date. The cancellations will be subject to a penalty as follows: Between 59 days and 30 days prior arrival day: 30% penalty of total tour amount; Between 29 days and 07 days prior arrival day: 70% penalty of total tour amount; Between 07 days and the arrival day: 100% penalty of total tour amount; The cancellation terms can be subject to variations due to special events, Int’l. exhibition and congress periods. Any variation on the cancellation terms will be communicated to the customer before the reservation. If the deposit and/or balance is not paid in time, we shall cancel your travel arrangements. If the balance is not paid in time we shall retain your deposit
Cancellations for Covid-19 emergency restrictions
Covid-19 emergency events:
- Passengers who test positive for the molecular swab certified by local health authorities prior to departure
- Passengers subject to quarantine by decision of local health authorities with official communications prior to departure
- Inability to reach the destination due to a declaration of access restrictions by the local health authorities due to an emergency virus infection
- Cancellation of manifestations and events in the travel programs by the local health authorities due to virus contagion emergency
Passengers subject to the events of articles 1,2,3,4 will be able to change their departure dates free of charge till 7 days prior to arrival date. They will be entitled to a voucher of the same amount as the cancelled trip to be used within 1 year from the date of cancellation of the trip.
Cancellations for MSC Cruise passengers
The cruise package customers will be entitled to have a voucher and only in case of a Cruise cancelled by the MSC Cruise Company. We recommend to those passengers to buy a travel insurance for the cancellations. MSC cruise company will provide Covid-19 test to the passengers before embarking. This service called “Covid protection plan” is included in the package rates.
Rates
Prices are in EURO including VAT; any VAT increase will be charged to the customer and will be communicated 30 days before the Customer’s arrival.
Liability
Delos Holidays, acts as intermediary , between the Travel Agencies, Tour Operators and the suppliers and therefore cannot be called responsible for the negligent acts, or/and admissions of these independent contractors (the suppliers),their employers, agents, servants or representatives . Delos Holidays reserves the right of alteration to the service, the holiday, makes an alteration on or before, the date of balance of payment is due. We do not accept liabilities for alterations or cancellation owing to “force major”, circumstances such as war, riots, threat of wars, civil strife, government actions of restraint, fire, terrorist activities or any act of international lowness, natural calamities, and other “force major” circumstances may occurs. Liability of Delos Holidays can’t exceed anyhow the limits fixed by the Brussels Convention established on 1970(L.n.1084 dated 27 dec.1977). For any disputes the courts of Italy will be the only one entitled to an arbitral.
Travel insurance
We strongly recommend you to have an adequate travel insurance including tour package cancellations and local health assistance. The MSCcruise package customers are obliged to have a travel insurance with a coverage of minimum 50.000,00 EURO for health care expenses
Illness and disability
If you or any member of your party suffer from a disability or other medical condition, please tell us before you book as not all itineraries are suitable for them.
Complaints
Any complaint or problem during the stay must be reported immediately the local representative, agent, or supplier; this clause is part of this contract. If it is impossible to contact one of our representatives or our office, a written complaint must be forwarded directly to our office the same day of the complaint. A late complaint will not be taken in consideration.
Substitutions
Delos Holidays reserves the right to replace the booked services (hotels, restaurants, transfers, etc.) with other equivalent services if the circumstances require it at no additional cost and without reimbursement to the members of the trip
Personal belongings and Baggage disclaimer
Delos Holidays is not responsible for personal belongings and luggages and does not assume liability or accept claims for loss and damage to luggage breakage, theft or wear and tear through hotels and carrier handling.
Force Majeure
Neither the Customer nor the Delos Holidays hereto shall be deemed to be in breach of these terms and conditions or otherwise be liable for failure to perform or delay in performing any of the Delos Holidays’ obligations hereunder on account of force majeure, provided that the party affected shall as soon as reasonably possible inform the other of the occurrence of a force majeure event. Force majeure means circumstances beyond the affected party’s reasonable control which are unforeseeable or unavoidable after taking all due care. Without prejudice to the generality of the foregoing, the following shall be regarded as causes beyond the affected Party’s reasonable control acts of God, explosion, flood, tempest, perils of the sea, fire, accident, war or threat of war, acts of terrorism (actual or threatened), sabotage, insurrection, civil disturbance or requisition, acts, restrictions, regulations, bye-laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority, embargoes, strikes, lock-outs or other form of industrial action or trade disputes, whether threatened, restrictions due to a virus pandemic event.
Data Protection
The Customer agrees that Delos Holidays is permitted to hold personal information of the passengers and share them with the local suppliers. The data protection and privacy terms are listed in our web site under the section http://www.delosholidays/about us/our privacy policy.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed and enforced in accordance with Italian Law. The courts of Italy shall have exclusive jurisdiction to settle any disputes, which may arise out of or in connection with this Agreement.
